Re: burglary of a habitation

Standard burglary of a habitation is a second degree felony. The punishment range for a 2nd degree felony in texas is 2-20 years in prison and up to a $10,000 fine. Depending on the details of the offense, it could be considered a 1st degree felony which would have a punishment range of 5-99 years or life in prison and the same fine potential.

Most are of the 2nd degree variety.
