Burglary of habitation w/ intent to assault

My fiance' has been incarcerated for almost exactly 4 months and he still hasn�t been indicted. He is been held on charges that I made against him. I have gone to the district attorney's office to try and drop the charges and retract my original statement because the allegations against him are completely false; however, the district attorney is still persistent on pursuing the charges. I have made clear that I will not testify against him should we go to trial no matter how much they may try to force their hand. I don't know what the hold up is but I feel that I've done all that I can do. What would you suggest and how long does the prosecutor handling this case have to indict him?

This is a first degree felony, which will not go away as easily as you wish. He needs a lawyer by tomorrow -- should have had one months ago. You may end up needing one as well.
