Legal Question in Criminal Law in Texas
I call the police on my husband yesterday because he grab me by the back of my neck and pus me on the floor. He didn't choke me nor cause me to loose breathe or to be unconcience. The officer said. He was going to be charged with felony 3 though he is 29 and has never been in trouble with the law. Is this a fair sentence?

It is not up to the officer - it is up to the prosecutors' office. If he did not impede your airway, did not cause serious bodily injury, and did not use a deadly weapon, and he has no priors, then it should be & probably will be charged as a class a misdemeanor. He needs a lawyer.
