Is my case finished for good?
I was arrested for assult/fv. this was a misdemeanor A. my cash bond was refunded to me and they said it was becuase the DA refused the case. My criminal background check came back for a employer and it says the case is still open. My thought was, once the bond is reissed back to me, the case is over and done with. My lawyer said it was closed but why would this background check say the case was still active? This is the fist time this has happened to me and im worried ive missed something and i could be re arrested for not following the right legal procedure.

The case may have been refiled or the employer may be reading the background check incorrectly. Additionally, if the case was delayed in filing it may have been recently filed. If you call the local sheriff's office they will be able to tell you if you in fact have a warrant. The Dallas County Sheriff has a warrant line.
Should you find that the case was resolved, i.e. not filed you can get the information expunged. The information will remain on the computer system if it is not. The DA may require you wait until the statute of limitations has run, i.e., the time period in which a case must be file.

Your case could be filed within two years of the offense date if this is your first A/FV charge.
What has most likely happened is that your case has been dismissed, however your criminal record will always show that you were arrested for the crime unless your get the arrest expunged.
But rest assured that your record does not show a conviction.
