Legal Question in Criminal Law in Texas
If I was charged with a misdemeanor charge of Assault Family Violence causing bodily injury and I have no prior assault or violent charges can that charge be enhanced to a Felony charge of Agg Assault using the same information.

Yes. Aggravated Assault doesn't require a prior. You are getting Aggravated Assault confused with Assault f/v enhanced.
