Legal Question in Criminal Law in Texas

I was charged with theft by check in 2006. I had no idea there had been any such warrents issued. I was recently stopped for a trafic violation and arrested for the warrent. Do I need a lawyer and since the check is for 46 dollars can I just pay the check and any fees and expect to walk away from this a free man?

Normally the DA sends letters demanding that you pay the check and associated fees.. If you do not respond in time, a warrant is issued. In Bexar county, there is a standard offer whereby if you pay all outstanding checks and fees (not just the one they are charging), they will dismiss. There may be a similar offer in your county.

Otherwise, you are looking at a class B misdemeanor. This charge has be be resolved. The options are dismissal, acquittal, conviction or plea bargain which would usually result in regular or deferred adjudication probation.. If you can't afford an attorney, the court should appoint one for you.
