Legal Question in Criminal Law in Texas
I was charged with theft over $750. in 1994.The judge wasn`t clear if it was a felony or not.

I think $750 was the cutoff between misdemeanor and third degree felony theft until I September 1, 1993, t which point they created state jail felonies and changed all the thresholds. If the offense itself took place before then, it would have been charged under the old law and would be a third degree felony. After that, I think there may have still been one or two specific theft offenses that kept the $750 threshold for a while (seems like maybe theft by check and/or theft by a public servant kept the $750 for a while), but for a garden variety theft case, the threshold between misdemeanor and felony is was changed to $1500 in 1993.
