Legal Question in Criminal Law in Texas
Child Abandonment
My friend was arrested on Sunday night after a routine traffic violation. She was arrested because she had a ''warrant'' out for her arrest for child abandonment, which she didn't even know about, hadn't received any notices about, nothing. She had received the child abandonment case when she left her two children in the apartment alone for a few minutes while she went to the mailbox. CPS dropped the case and closed it. Dallas county didnt. Now, she's been sitting in a jail outside of Dallas county for 3 days waiting for Dallas to come pick her up. We, her family and friends, are at a loss of what to do. They tell us that child abandonment is a felony and that she will be sitting in the county till Dallas comes and picks her up! Then, we have to wait until they process her, take her before a judge, and post bail. Finally, after that ordeal, we will be able to bail her out. At the pace that they are moving, this woman will have lost both her jobs, subsequently, her apartment and car, and possibly her children, if their father has anything to say about it. Is there anything we can do to get this process to her eventual freedom going so we can fight this?

Re: Child Abandonment
You can retain an attorney for her to force a bail hearing, at which time a judge can order bail set, she be released pending proper filing of the charges, or give Dallas a deadline to pick her up.
As her family and friends however, you need to be hiring an attorney primarily to fight this case. Be prepared for a civil case for custody to follow quickly, as well.
