Child Molestation
Why do I need an lawyer? I was called by a Det. stating that I needed to talk to her about my ex-girlfrind and her daughter (8yrs old), I ask why and she stated that she wants to ask me about molesting the daughter, after cooling down I called some lawyers here and each and everyone on them asked me if I had said anything to the Det., I told them that I had agreed to meet with the Det. and would take a polygrapg test that the Det. wanted, but had said nothing else, I was told that if the Det. called back to say that I would not speak to them without a Lawyer present, the Det. has not called back and now I'm wondering that maybe the Det. thinks that by not meeting with them I feel that they think I'm not doing this because I'm guilty, what have I done???? I never molested the child. Did I mess things up?

Those lawyers you talked to gave you good advice. A law enforcement polygraph may or may not be accurate. If that detective had a case, you would have been arrested, not 'chatted with'. A chat with the detective would not have helped you, but may have hurt you. Do not discuss this accusation with anyone except an attorney you have retained.

You did the right thing, absolutely. We handle a lot of these cases and all too often see suspects interviewed by the Police without proper legal representation. Any lawyer with experience in this area will advise you against interviewing with law enforcement, without counsel, for various reasons.
First, you cannot talk yourself out of this type of case. In fact, when suspects attempt to do so, they often implicate themselves even further by revealing information which appeared on its face to be helpful, but when taken with other facts, hurts even more. Second, many suspects, for a variety of reasons, feel compelled to confess, either to prevent embarrassment to themselves or their family. Law enforcement is trained about this psychology and will attempt to pressure suspects into confessions. Law enforcement will also tell you if you have nothing to hide you don�t need an attorney or if you cooperated they will go easy on you. These are all just typical law enforcement tactics to get you to talk.
The reason you need an attorney in these situations is simple. Your attorney can discuss the case with investigators without anything that is said being used against you. We can often elicit enough information from law enforcement to get a better understanding of the allegations and facts surrounding the case. Then we can discuss the case with our clients and form an appropriate strategy, which in some cases could involve cooperation. The bottom line is DO NOT, EVER, allow yourself to be questioned regarding suspected criminal activity. You can tell the investigator you want to cooperate but want to have your attorney present.
