Legal Question in Criminal Law in Texas
child sexual abuse
if the non-accused parent has had knowledge of the sexual act committed by the other, is that parent also guilty? what would be the sentance for that parent? can that parent, upon learning of his/hers impending arrest for knowledge, legally escape prosecution, and how?

The non-abusing parent, so-called, who has actual knowledge of the abuse and takes no action, is a co-conspirator with the abuser and will usually be prosecuted and punished in the same manner as the principal. The type of punishment may well depend upon the type and extent of abuse, and the age of the victim.
One cannot escape prosecution, one can only defend against it. Everyone is entitled to a defense.
