Civil Suit from store for shoplifting (Williamson County)
My daughter got ''arrested'' for shoplifting. Class C Misdemeanor for theft under $50.
We haven't even gone to court yet but have already received a letter from the store stating they have the right to seek ''civil relief'' without regard of return of merchandise and outcome of criminal prosecution.
My understanding of that TX law is around recovering for damages or items they didn't get back. There were no damages and they got the item back (undamaged).
Can they really come after us for this money? They want $200 stating I have 30 days to pay or they will take further civil action to include attorney's fees and costs.

yes. My clients get these letters all the time. I always advise them to ignore them. None of my clients have ever been sued.
