Legal Question in Criminal Law in Texas

Class B Misdemeaner

My son is 21 years of age and a Senior in a University. He was ''hanging out'' with the wrong group one night. There was drinking and he was trying to settle a dispute between two groups. The police were called and he ran when they showed up (because he was scared): hence, was arrested (evading arrest). NO one else was arrested. He has never been in trouble and he can't afford an attorney. Can he go to court and pled with the judge to remove this from his record? Everyone we talk to says he needs to hire an attorney. He needs to fulfill an internship and I am afraid this will ruin his chances...not to mention he wants to go to nursing school.

Re: Class B Misdemeaner

In my experience, asking for leniency accomplishes little, if anything. The judge will only be interested in knowing if he is pleading no contest, guilty or not guilty. If one of the first two, he is facing a possible conviction; if the latter, then the judge will set it for trial. He needs a lawyer. If he is young and healthy, he can get a parttime job to pay the lawyer. Most will work on a payment plan.
