Legal Question in Criminal Law in Texas

class B misdemeanor theft 50 100

My son and a ''friend'' were caught attempting to shoplift at a Walmart. They were arrested, handcuffed, taken to station, fingerprinted, and photo'd. Held there pending decision to release to parents or detention center. Parents told not to come unless called. Now we have a letter to meet with a probation officer who wants birth certificate, immunization records, SS card, & insurance card. Why all this info? It sounds like he's going to be ''taken away'' without court, etc. What do we need to do? Need answer ASAP. Son has full time job, top 3% of class, made a bad choice.

First and foremost, hire a competent lawyer to handle your son's case. I assume your son is a juvenile and has a meeting with the probation department. It is not uncommon to meet with a probation officer before going to court. However, the answers your son gives and/or the answers you give can have an impact on the ultimate disposition of the case.

Your son is not going to jail if he has a competent lawyer.
