Legal Question in Criminal Law in Texas
I have a class C misdeamnor which I was charge for in 2003, for defending myself against my crazy ex-wife which I divorce for it after repeated stabbs and was given 4 years in jail but later dropped to 2years with community service only which isn't fair to me. I'm having problems getting on with my life and getting hired. I only spend 3 days in jail and was my first, but for her it happen several times. Class C misdemeanor convictions are not punishable by incarceration. They only carry a fine in the range of punishment. It is more likely that you were convicted of a Class A misdemeanor which carries 4 years of jail time in the maximum range of punishment. From what you state, it sounds like your 4 year sentence was probated or modified.
This conviction could be causing you problems getting a job because employers often check criminal records and will reject applicants based upon a criminal record. You need to need to see an attorney who does expunctions or motions for non disclosure to see if you are eligible for an expunction. My guess is that you need to get your conviction pardoned in order to be eligible for an expunction.
