Class C Misdemeanor Theft
My daughter went in front of a municipal court judge and received a fine and court cost for a theft under $50. I then received a letter from the store that she was caught stating that they demanded $150 for damages they encountered. Although they recovered everything that was taken. Can they take me to court if this payment is not paid. My daughter is 15 years old.

Do not pay this fee. However, I must warn you that they may attempt to put it on your credit listing, but I would still not pay the fee. Texas set this fee up for stores to use to get back their out of pocket expenses for either damage or no return of the property. However, the stores are abusing this by sending everyone who gets in trouble like your daughter to also pay these fees, I personally do not believe that there is a jury around who will grant them money if they sue you for not paying the fee.
