Legal Question in Criminal Law in Texas
Can a class A misdemeanor Assault Bodily Injury be expunged in Tx...
1 Answer from Attorneys
The answer to that's actually going to depend mostly on what happened with the case, not what kind of case it is. The short version is that it can probably be expunged as long as the case was dismissed and it's been at least two years since the arrest. If there was a conviction, or even if there was deferred adjudication or ANY probation at all, then the case can never be expunged. If this was not a family violence case, and deferred adjudication was granted and successfully completed at least two years ago, then the case may qualify for an order of nondisclosure, which wouldn't actually destroy the records, but would seal them for most purposes. If it sounds like you might qualify, I handle a lot of both of these and you're welcome to contact me for more information.
