Legal Question in Criminal Law in Texas
Class A Misdemeanor
I need some help.
One night my fiancee and I got into
an argument. I threw a lighter at the
wall & it accidentally hit her. The
neigbhors called the cops due to all
the yelling. My fiancee (who is 5ft
tall) was intimidated when the officer
started saying stuff like ''I know he
hit you & if you don't tell me your
going to jail for lying''. My fiancee
being young & naive told everything.
He said he would just talk to us, but
then his buddies arrived & he wound
up arresting me for ''probable cause'',
despite my fiancee crying & telling
them up and down never had a
history of violence and that this was
an accident.
My question is this. Based
on the fact that I have never had a
history of violence, I have never been
charged/arrested by the police, and
the fact my fiancee said she is more
then ready to testify for my defense,
what kind of punishment do you
think I could face? Is there anyway
of getting this dismissed? I am 20, a
new father & in order to get
promoted within my company, I can't
have a class a on my record & we are
too poor to afford an attorney.

Hello there,
If you are to poor to hire an attorney you need to fill out a paupers oath affidavit and ask the court to appoint you an attorney.
Given the facts of your case it sounds that you could have a good chance of a not guilty verdict or a dismissal. However, no one can guarantee these things are going to happen.
You need a lawyer.
Don't mess up and take a plea without one.
