Legal Question in Criminal Law in Texas
Confused and Scared
My husband got a call stating that his wife(me)was a suspect in a harassment case and that I was unreachable and that I needed to contact the S.O. or they would issue a warrant.After trying to call, we have yet to get the detective to call back.We have no case #. The complaint was filed by my husbands ex-girlfriend,and we are suspicious that it is a friend of her's handling the case.She is also the person who contacted me by phone. We have not talked since that call. I am curious to what my rights are. My husband and I live in another state,1000 miles away.We don't even know if this is a criminal or a civil charge. We are unsure as to why they contacted my husband instead of me. (If I am allegedly harassing someone, how can I be unreachable?) She works for the City that the complaint was filed. What are my rights? Why is there a warrant? Can I get a change of venue for a conflict of interest since she works for the city? What do I need to do for myself in this issue? Do I have to speak to the det. or can I get the info. and contact a lawyer? I don't know much about the law, but this seems a little extreme over 1 phone call. Do situations like this usually go to trial?I know this alot but I am really upset and sick over this

First of all, do not make any more calls to the Sheriff's Office. Don't talk with anyone, except a lawyer. For a reasonable retainer, hire a lawyer in that town, to find out what (if anything) is going on. My guess is that nothing is going on -- except that an ex-girlfriend may have abused governmental authority.
If there is a charge, then you can retain that attorney to resolve the matter. If there is not a charge, then it was money well-spent for that information. Additionally, the attorney may learn if the ex-girlfriend abused authority in using a deputy to make the call.
