Legal Question in Criminal Law in Texas

confused

Hello, and thank you for your time. I was wondering what excatly is possesion doesn't it have to be on you or in your property ? I currently am facing a felony drug charge on drugs that were on the floor next to me in a hotel room (which was not under my name) with 5 other people in the room 2 of which were also within the same distance from the drugs as i was. This case has been delayed for almost 2 years now. isn't there a statue of limitations and do you think there is any possiablity i can get it dropped down to a lesser charge or dismissed becasue of inconclusive evidence?? sorry the details are vague thats basicly all there is on the case once again thank for your time

Possession means to exercise control over -- if these are the sole facts of the case, you should hire a lawyer to see about getting it dismissed. On the other hand, it is not unusual to allow such lapses of time, as the state's case, as a general rule, gets weaker as time goes by.
