Legal Question in Criminal Law in Texas
Conspiracy
My husband has been in a Federal Dentention Center since 03-04-03. He has been indicted on a conspiracy charge. The investorgators went to different prisons in Texas showing his picture and asking questions. All the statements were giving in 2002 but the event where to have happen in 95 - 97. How long can they hold him before they plea with him or sentence him? Can the keep moving the court date? Someone told he they can only hold him for 6 months after that they have to charge him or let him go. Is this true?

There is a Speedy Trial Act in federal law (not in state law), and a further constitutional right to Speedy Trial (Barker v. Wingo). He will need a lawyer before they "Sweat" a confession out of him.
