Legal Question in Criminal Law in Texas
controlled substance
in april of 2005 i was at my apartment with a few friends playing video games and such ( no drug use at all)
1 more of my friends came over and brought someone with him that i didnt know too well. Well the cops came saying that they got a call we were smoking pot. I invited them into my apartment because i knew we hadnt. They came in didnt smell anything and were just about to leave when they heard this loud thud in a room i wasnt in. So they go back there and the guy that was in there comes out of the room and they find his methamphetamine and cocaine along with 1000 dollars in cash he got from dealing.
so the cops ask whos it is and i couldnt answer because at the time i didnt know. My friend said it was all his to take the blame off of me. And they took us both to jail and pocket that 1000 dollars. With me showing no signs of criminal intent and with the part about the noise documented in the police report what do you think in your honest opinion my chances are of getting a not guilty verdict? they're trying to plea me 4 years probation but im innocent. if guilty of anything i chose bad friends

Depends.
On how good your lawyer is. How good the jury is. How credible you are. How credible your witnesses are. Whether the cops back up your version of events. Whether your friends are still telling the same story....
In other words -- a trial is impossible to predict ahead of time -- there are so many factors that come into play -- but a felony conviction for drugs will follow you around forever -- it's a tough decision, but one only you can make.
