Legal Question in Criminal Law in Texas
Corporate theft vs embezzlement altering employees bonuses
If the co or secretary of funds takes $100k to $200k from the
cash sales and deletes accounts to cover it up, can I as a spouse sue said person separately from my divorce?
Can an outsider files sues too?
How to get the investigation started? Who to turn it into.
I have family members on tape telling me who stole money and from what accounts and where etc.
Taping conversations with one persion is legal in TX.

Re: Corporate theft vs embezzlement altering employees bonuses
The spouse would have two options. A civil suit against the company and/or the individual thief. A criminal prosecution against the company and/or individual thief. Quality of proof will be the standard to determine if there a viable case either civilly or criminally. Additionally, the spouse will have to establish a property interest in the funds, as well as a depletion of the funds by their wrongful action. The spouse will have to hire a lawyer to pursue the case in civil court. The police would handle the criminal investigation. In the divorce it would be helpful for the court to rule that the funds were the property of this spouse.
The spouse should seek legal representation to pursue either claim.
