Legal Question in Criminal Law in Texas
can i still be covicted on a second degree enhanced Felony/w-Previous Conviction, if there is no victim present is there a chance of beating this case ?

You have a right to confront the witness against you. If the witness is not available, chances are the State cannot move forward. However, this is more complicated than it seems. You really do need to consult and hire an attorney.
