Legal Question in Criminal Law in Texas

Is this a crime?

A man pumps gas in a gas station.

He goes in to pay for his gas.

The clerk asks the man if he is in the military and the man says yes.

The clerk then says ''Get out! Get out! You are not welcome here. US Army are murderers.'' Sean said ''Let me pay for my gas.'' The ME man said ''NO! Get out. Your money is not welcome here.''

I would like to know if a crime has been committed here.

Thank you

Re: Is this a crime?

Most businesses have the right to refuse service to anyone, and military is not a protected class (such as age, religion, race, national origin), so my initial reaction is "NO". I should mention that you have asked for an answer according to Texas law, and as I am only licensed in California, I can only give you the law in CA. You may wish to submit your answer in TX or see a lawyer in TX.
