Legal Question in Criminal Law in Texas
Criminal Charges
My husband had a warrant issued for agg robb for one crime scene however the DA is inditing on another case that is not the one he was arrested for. THere has been no mention of the original one in the warrant since the arrest. Is this legal?

Re: Criminal Charges
If the DA has sufficient evidence to take to the Grand Jury, and obtain an indictment, then he can do so. Your husband would be arrested on the basis of the indictment. If the first charge was only a ruse for some unknown purpose, then it would be up to his attorney to pursue that argument; although am not sure what it would accomplish.
