Legal Question in Criminal Law in Texas

Criminal Dismissal Expunged

8 years ago I was indicted by a Grand Jury for theft charges. However, after proving my innocence to the District Attorney prior to trial, he dismissed my case without prejudice. I want to make sure my record has definitely been expunged. How can I find out that information on my own instead of hiring an attorney? Also, when a criminal record is expunged, do they remove fingerprints, photos, etc. from the database? If not, wouldn't that be incriminating evidence? Thank you for your help.

Re: Criminal Dismissal Expunged

Just because the District Attorney dismissed your case does not mean your record is expunged. In fact, if you never filed the lawsuit to have it expunged, your record is still there. Check with the local District Clerk's office in the county where the charges were originally filed. If I am right that it has not been expunged, my advice would be that you hire an attorney to see about having it expunged. When a record is expunged, all fingerprint cards, arrest records, jail records are eradicated as if it doesn't exist.
