Legal Question in Criminal Law in Texas
Criminal Law; Theft Punishment
If a person has no criminal record and theft are convicted of theft of $100, a class B misdemeanor, what is the most probable punishment if you don't have any priors (no criminal record). I already know the maximum punishment. I'm asking what the most likely punishment would be. What are the factors that a judge considers when sentencing a person who is being tried for theft, class b misdemeanor?

If handled correctly, the person should not even have a conviction, but get deferred adjudication. (or depending on age and circumstances -- diversion). If not, then probation -- the length, fine, costs and conditions are different from county to county.
