Legal Question in Criminal Law in Texas
criminal probation
A friend was taking mandatory polygraph when the examiner asked him questions about a specific date. Being aver 55 he paused to try to remember and failed the test. Does he have any recourse?

If that is the reason he failed the test, then the examiner is not competent.
Otherwise he failed the test for a different reason.
Without disclosing to authorities, his attorney can take him to a competent polygrapher for another test, and determine if there is a different outcome. If handled correctly the results would be privileged.
