Legal Question in Criminal Law in Texas

criminal probation

I was given 10 years probation for arson by a jury with no restition. However the judge added 125,000 to be paid at a rate if 1,500 a month. Five years now with no other offences but 64,000 behind in restitution though I proved I am financilly unable to pay so much the judge gave me 90 days to pay a ''substantial'' amount or she will revoke my probation and send me to prison. Is there anyting I can do? and is this legal? Please help.

You are in dire need of an attorney with the balls to tell that judge he/she cannot revoke your probation on the fact you cannot pay your restitution!!!

There are two types of violations one can get while on probation.

1. A new criminal offense;

2. A technical violation of your probation conditions.

The violation you have described is a technical violation and should not be revoked on your inability to pay restitution.

Get a lawyer. If you can not afford a lawyer ask for one to be appointed to you.

Make sure the lawyer you hire understands probation revocations well.
