Legal Question in Criminal Law in Texas
Criminal restitution.
I was sentenced to seven years tdcjid in 1991 with 7000.00 in restitution. I was subsequently sentenced to 17 years for dwi. I served a total of over twelve years. Since so much time has elapsed since the originga sentence am I still responsible to pay it? I am on parole for the DWI and they are telling me I still owe this amount. Please inform me if you can, Thank You. Homeless and in a shelter unable to pay anything.

Based on what you have written and generally speaking, when people do not have the ability to pay restitution; they might want to consider going to the court and explain the circumstances. Generally, some courts may waive the restitution, extend the payments, etc. Generally, if the party does nothing and does not pay, the court may take that non-payment as a sign of contempt towards the court.
