Criminal Trespasing Warning
While walking my dog in neighborhood school yard I had police called on me. An individual working for after school day care beleives I am following her. She claims I followed her in grocery store, to her house and at school. I have no knowledge of this individual. The police gave me a criminal tresspasing warning and told me if I came back to school property I could be arrested. When I spoke with detective I was told I could not obtain criminal complaint and that the case appeared to be heading to a stalking charge. Detective informed me to stay away from school, do not call school or any other official and that I can not obtain criminal complaint because the case is still under investigation. Again I have no knowledge of individual making complaint. I am not stalker just regular joe minding own business while walking dog. I am obeying all orders. What are my rights?

1. You have the right to remain silent. Exercise it.
2. You have the right to counsel. Obtain it.
3. You have a right to a trial and the compulsatory attendance of witnesses on your behalf and the right of cross-examination of the government's witnesses - do it.
When you prevail on the charges against you, then you can consult a civil rights lawyer about an "abuse of process" and/or "false arrest" claim.
