Legal Question in Criminal Law in Texas
DA to add another charge 6 mos. later
I have a case pending in Harris County for DWI that occured in November 2007. I did not accept their plea deal last month and as a result I was informed today that they are going to add another charge to my case. I was licensed to carry a concealed handgun which was in my vehicle at the time I was pulled over. And now they are going to charge me with that!
Can they actually do this 6 months later? It just does not seem right that because I did not accept their plea deal that they would now add another charge.

I am presuming that you have hired an attorney and as such, you need to talk with your attorney about the case, however, like it or not, the DA's office can file the charges.
