Legal Question in Criminal Law in Texas
DA Filing Case - HELP!
I was arreseted for poss of marij 2 oz back in September--the case facts are weak as the driver admitted to ownership of the mj including the joint. The officer arrested me anyway with nothing on my person. My question is the court case has yet to be filed (been a little under a month) so does the DA have to file the case? Is there a statute of limitations on how they long they have to file the case? They won't let me set an arraignment date and I am getting nervous. Please help.

The da can choose to not file the case. They have up to 2 years (the statute of limitations) after the date of offense to file the charge.
