Legal Question in Criminal Law in Texas
My daughter took a check that was written to me (from my aunt). Thank goodness I discovered it missing and had my aunt put a stop payment on it the next day. My daughter took it to a bank, opened an account. Of course it wasn't funded due to the stop payment. State is Texas. If I press charges (she's stolen from me before) I know the worse is forgery. Since the transaction did not go through due to the stop payment. what are my options?

You options are to involve the police in your family situation or not. If you involve the police, then it is a forgery charge for which she could receive from probation (if she qualifies) to prison time.
