Legal Question in Criminal Law in Texas
My daughter has court Jan. 10,2011 for Disorderly Conduct by Threat. Need Help. Her friend wrote her a note in class saying "i hate you" My daughter wrote back "i hate you" then the little girl wrote back "i hate you , you hate me, lets get together and kill Ben" ( Ben is my daughters boyfriend) My daughter gave the note to her boyfriend Ben and he put it in his desk. The teacher found it and turned it in. The police pulled my child out of class and questioned her and took a statement without a parent or guardian present. I didn't receive a phone call or note sent home. She told me herself. The next week the school officer called and told me they are sending a citation home and have court on the 10th of Jan. The other little girl was suspended from school. Do I need an attorney and will this hurt my childs future? She is AB honor student and has never been in trouble.
