Legal Question in Criminal Law in Texas

My daughter(8years old) Stated to Me that While at a Sleep over at her Friends House,that the 11 year old Brother and His Friend dared My daughter to Play Sexualy Explixit Games with her. She states that No one took their Clothes Off but Did in her words "humping" And Kissing and Foldling. She felt Pressured to do those things and the ADULT in the house which was the Friends Mother, was already asleep and so was her girlfriend.. Later in the Night the Mother woke up and Caught the Boys in action and Stopped them.

My question is DID these Boys Sexualy Molest my Girl?

Even in cases where it can be proven that the minor victim was a willing participant, a sex act or improper touching is still a crime because children cannot legally consent to anything. Criminal penalties are severe for those convicted of child molestation. Consider this sexually inappropriate contact or more aptly described sexual assault is found under Texas Penal Code Ann. � 22.011 (Vernon Supp. 2006).
