Death Penalty
If you intentionally kill one person and have no priors, is it possible to get the death penalty. Does the jury consider the circumstances such as if it was a woman who killed a man who raped her as a child when they decide the fate of the defendent, or does it not matter who they killed and is just the simple fact that they took a life???

The death penaly is applicable only if charged and convicted of capital murder. Capital murder is murder with some aggravating factor, which is set forth in the Texas Penal Code 19.03. There are not only defenses to a crime, such as self-defense, but there are also justifications, which are also listed in the statute in Chapter 9 of the Penal Code. It is a list of excusable reasons for committing a crimne. TCL
