Legal Question in Criminal Law in Texas
On December 19, 2024, I was traveling in the far left lane on Northwest Highway in Dallas Texas with my 14 yr old daughter when a a large commercial cement truck came into my lane and hit my vehicle causing damage to the passenger mirror and sideswiped right side of vehicle causing over $6500 in damage to vehicle. The driver fled the scene but I was able to catch up to get photos of license plate and vehicle information. I managed to get the company infomation and reported the accident to them and the accepted responsibility for the incident and even claimed that they had fired the driver and even had the incident on video but they are proposing a low settlement. This is a case where their driver hit me and ran and would not stop and was throwing obscene hand gestures. My vehicle has not been drivable due to the damaged mirror becing completely ripped off. They have agreed to the coverage of the damage to have the vehicle fixed, HOWEVER, not at the dealership that I chose, They also have only offered $900 for car rental during the repair time. It appears to me they are trying to low ball me.I have the settlement offer for attorney to review. Please advise.

You should have reported it to the police then. You can try now. It is called failure to stop and give information. But, if he does not have money even if he is prosecuted you may not recover any and the company is not responsible for him failing to stop.
