Legal Question in Criminal Law in Texas
Defamation?
in 2001 a realestate matter reported to police was referenced to a grand jury regarding accusations of theft by deception. The case settled as a no bill for the realtor involved shortly thereafter.
An open records request of the incident 2/2007.
After this, 1 month after the request, a copy of the grand jury referral on only the realtor and a list of intended recipients which did not include the outcome of this 6 year dead case was mailed and received by some listed on the list. Without an outcome included, it implies the realtor is a criminal because someone had accused him of such.
Is this a case of Defamation?
If so, is it a criminal offense since it was sent in the US mail, or is it Civil?

I can't see where there is defamation or a criminal offense. It is what it is. A police investigation referred to the grand jury and no-billed. If the realtor involved wants the matter cleaned up, then the realtor needs to have the case files expunged.
