Legal Question in Criminal Law in Texas
Defendant lives out of state.
My son, who is 18, resides in Colorado. I recently moved to Texas from CO to proceed with a divorce. Something my son has been having a VERY HARD time dealing with. During one of his rebellious episodes he decided to drive to Texas without telling anyone, to try and pursue me back home. During his visit he was arrested for posessing marijuana. He has also found trouble in New Mexico where he was detained for 10 days a few weeks ago, In the mist of all the legal battles, (his, the divorce proceeding, and another case involving my daughter and her dog biting someone) We all overlooked his court appearance here in Texas. It was 2 days after his release in New Mexico. The judge rescheduled him for this Tuesday 05-29-07. The problem is transportation for him to arrive here from Colorado. Since it is during the holiday, and with such a short notice the rates are sky high. I personally called the judge to ask for a one week extension to which he denied. We are near the court date and can�t find a way to get him here due to our finances. If I hire an attorney, will he/she be able to get a warrant dropped for non appearance and possibly have the case transferred to CO? Until I hire an attorney can I appear in court for him?

Your best option is put him on a Greyhound bus and have him in court on the 29th.
Otherwise get a lawyer to do the best he/she can with this.
If you can't afford either one, then show up, explain to the prosecutor and/or the judge and hope for the best.
(And you need to figure out how long you are going to keep accepting responsibility for his behavior).
