Legal Question in Criminal Law in Texas
deferred adjudication ?
My husband was convicted of a theft he got 10 years probation deferred adjudication. He served all and on the last day when he went in they made him go to the sheriff's department and they booked him in again and then released him so now when you do a criminal search on him that�s what comes up. Is this right? It looks like he just committed the crime. I thought deferred adjudication meant it would not be on his record that�s what the lawyer said at the time.

Under deferred, the charges are dismissed if you successfully complete the probation period without any further violations. If he is charged with a new offense while on deferred, then he is faced with the original term of sentencing. Get him a lawyer right away.
