Legal Question in Criminal Law in Texas

deferred adjuification

I completed 5 yrs of probation for coke poss. The arrest was in June of 1987 and I completed probation and this shows discharge as of 2/1/1993. I was told this would drop off my record like many others. This felony shows up on a criminal background check. Until this month I have never had trouble geting a job or apt. Now This appears on my record 20 yrs later and I am being denied for anythin I apply for. Why is this now appearing and how do i get rid of this.

It is always going to show up on your record until you go back to court and file a motion for non disclosure.

Based on what you have written, you should consider filing a non-disclosure motion with the Court. This is different from an expunction, in that an expunction would completely remove the item from your criminal record. Note that there are specific requirements that must be met prior to being considered for expunctions. The non-disclosure will generally keep the information from being available to employers, landlords, and others.
