Legal Question in Criminal Law in Texas

Deferred?

I had an altercation with a former roomate. I was charged with assualt and sentenced to one year probation. I completed my probation successfully. I was told the assualt would not appear on my record. The charge appears on background checks and prevents me from obtaining jobs. How do I get it off? I think the statue of limitations has expired, but the info. was undiscoverable to me until now. My attorney did not inform me of the posiabality of an expunction. How shall I go about handeling it myself?

Re: Deferred?

If in fact the charge was deferred, and was completed successfully, then it appears on your record as dismissed. The arrest still appears. You might qualify for a non-disclosure order. Hire a lawyer to do this correctly. If you want to do it yourself, you will need to research the process at your county law library.
