Destroyed Prenup & Defamation

I am in the middle of an ''ugly'' divorce. This was sprung on me and the prenup we worked up and signed in front of a notary is missing. I have all of the evidence to show the document existed and was signed. Can I file criminal charges of attempted grand larceny against my wife? This is complicated since the original is missing and the divorce is ongoing.

Can I file criminal charges before the divorce goes to court, I'm afraid that if I wait, the court will see it as retaliation. She stands to gain $250,000 - $350,000 by destroying/hiding the prenup.

Also she has told 3 people that have confided in me that �you don�t know what went on in the house� It took these people a little while to contact me, but they were concerned that I seemed to be a good guy and what went on they asked. It is misleading, and defames my character. To a point where people I know well are hesitant to ask me. There is ZERO documentation that I ever did anything as she misleads people. It is all to justify wanting a divorce and getting money illegally.

Since you are in the middle of an 'ugly' divorce, you should be represented by an attorney, and should be posing these questions to your attorney.

Anyone can file a complaint with the police, it doesn't mean that there is sufficient evidence for the police to decide to file charges. It may backfire on you, and you should consult with your attorney, as to the pros and cons of such a decision.
