Legal Question in Criminal Law in Texas
Detective isn't pressing charges....??
I was arrested approx. 3 months ago for domestic violence (the charge was assault with bodily injury). I was taken to jail at the time, and arraigned. I was released on bond the next day. My boyfriend filled out a non-prosecution form and we talked to the detective. He did not file charges, so I do not have any court date. He told us that nothing more will happen and that we will get something in the mail saying that the charges are dropped...but the bond place keeps telling me when I call that the state will pick my case up. Who is right? I would like to just put this behind me. I am not a batterer (I'm a woman by the way). I had been put on an anti-depressant that I never should have been...and apparently there are several lawsuits due to the fact that the meds an cause severe rage in some people. I just need to know so that I an prepare myself. Thanks for any help.

The bondsman could be right. You will have to wait and see. Sometimes the PD completes and files the report of the investigation with the DA (or in some cases the grand jury). In those cases, the intake division decides whether to pursue the case further. You may want to retain an attorney to be the contact person.
