Legal Question in Criminal Law in Texas
Differed adjudication
I am charged with family violence. The DA office offered me a pre trial diversion in which I take some coinselling and be done with it. My wife who is the alleged victim refuses to sign the consent so that I can sign up for pre trial diversion. Based on this the DA office is taken away the offer. My question is, do all plea bargaining offers will have to get my wifes approval, for example what if they offer me differed adjudication will that require her approval also?

Different DA offices have different policies. Often, prior to certain plea offers, some will ask for the consent of the victim. It all depends on the offer, the locale, and the strength and weakness of their case.
