Legal Question in Criminal Law in Texas

I am going through a divorce. When my husband moved out he got his own checking account.He asked me to pay our truck note I said sure like i always do and have.He gave me his account number and routing number to make the truck note. I had wrote it down on the same piece of paper that I had my grandmothers information that she had given me to help me out some. When I paid some of my bills I accidently used his account numbers.well 4 months have gone by didnt realize it I got a phone call 2 wks ago him accusing me of stealing.I was like what are you talking about.Why didnt he come to me sooner and tell me what was happening.Now he is threating to press charges.I told him it was a mistake and I have already given him 300.00 back.the divorce wont be final till the middle of Oct.09.I am not on his account ,but he did give me the account information to pay the truck note.can he press charges against me or the bank press charges when he gave me his account information? thank you

If the divorce was not final, you could claim that you have a community interest in the funds anyway. Anyone can file a complaint. It is unlikely that a DA will accept a case of a husband stealing from a wife. Tell your divorce lawyer about this.
