Legal Question in Criminal Law in Texas

My brother has recently been assulted by his former girlfriend. She has been arrested twice in KY for aggrivated assult against him (once as a minor and again shortly after she turned 18-within 6 months). After the most recent assult he contacted his local police department (abilene, tx) who then took pitures of his injuries and took a complete report. During this incident he had his 7 month old son in his hands and pushed her away to protect himself and his child. Now a few days later he has been given notice that she has placed a restraining order on him. She claims that he was the one that was abusive during the duration of their relationship and has documented her injuries by photo of the incident. The police spoke with her after the incident occured and stated to my brother that she had no markings on her. My brother is now forbidden from seeing his child. I guess my question is what should he do? Should he have a lawyer and if so is there a public attorney that would take a case like this? Will he be able to get this restraining order overturned?

Absolutely he needs a lawyer. He can try Legal Aid, but don't hold out much hope. Instead talk to private attorneys who would be willing to work on a payment plan.
