Legal Question in Criminal Law in Texas
Domestic Violence
In 1997, I entered an plea of guilty to an dometic violence charge. But, the only thing is I was not guilty, I entered the plea because I was poor and could not afford an free world attorney. MY former spouse and I had an arguement, and she had broke up some dishes in the sink cutting her hand causing her to bleed severely. When the police arrived on the scene she had told them that I hit her and knocked her out, but that was not the true story. She showed up in court to tell them I was not guilty, but she was told if she changed her story she would be locked up for falsifying an offical police report, so she did not testify on my behalf.
Can I get the guilty gharge overturned and eraised from my record?

Re: Domestic Violence
It would be very difficult, probably expensive, and the problem still exists that someone lied and could be prosecuted for it.
This demonstrates why one should always have a lawyer to advise them before entering a plea. Those with no money are entitled to the public defender.
Are you aware that you can no longer possess a firearm because of your conviction?
