Legal Question in Criminal Law in Texas
Domestic Violence
If a husband beat up his wife, and she wrote out a sworn statement and pictures were taken. Can charges be dropped if she/he are now claiming that he was only ''Protecting her'' from harming herself, because she's bi-polar and because she has a history of suicide attempts?

Re: Domestic Violence
It would be discretionary with the ADA, and every office has their own policy in place. It sounds unlikely. Instead it would more likely be a defense raised at trial. Whether or not it would be a successful defense would depend upon the defense lawyer, and the validity of the evidence.
